DeKalb County police don’t intend to charge a man who shot and killed a person who was allegedly robbing him outside an apartment complex this week.

Cedric Spears, 20, died at East Perimeter Pointe Apartments on Snapfinger Woods Drive last Sunday at about 1 a.m., police said. Officers were told Spears and one or two other suspects who fled, attempted to rob two men in the parking lot.

One snatched a gold necklace off the shooter and took his iPhone. The robbery crew was armed and at least one had a gun drawn before the man pulled his own gun and fired, according to a police report.

“The shooter will not be charged because he was the victim of an armed robbery. It is being classified as a justifiable homicide,” Lt. Lonzy Robertson told The Atlanta Journal-Constitution.

Spears was shot in the head and in the chest and fell near the woodline.
